IMPORTANT: BY USING YOUR LUBN-BRANDED HARDWARE PRODUCT YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THE LUBN LIMITED WARRANTY (“WARRANTY”) AS SET OUT BELOW.

DO NOT USE YOUR PRODUCT UNTIL YOU HAVE READ THE TERMS OF THE WARRANTY. IF YOU DO NOT AGREE TO THE TERMS OF THE WARRANTY, DO NOT USE THE PRODUCT AND RETURN IT WITHIN THE RETURN PERIOD STATED IN LUBN’S RETURN AND REFUND POLICY, LOCATED AT https://lubn.com/pages/refund-policies

WHAT IS COVERED BY THIS WARRANTY?

Limited Warranty. Lubn warrants to Customer that the Hardware, as delivered, will be free from defects in materials and workmanship for the applicable Warranty Period specified below: 

• Lubn Lockbox 3: The Warranty Period is three (3) years from the date of delivery, provided that the Customer maintains an active, uninterrupted Enterprise plan subscription throughout this term. If the Enterprise plan subscription is cancelled or downgraded, the Warranty Period for Lubn Lockbox 3 shall expire immediately.
• Legacy Hardware (All other versions) and non-Enterprise plan subscription: The Warranty Period is one (1) year from the date such product is delivered to Customer. 

Exclusions and Remedy. Lubn’s sole liability and Customer’s exclusive remedy for Hardware that fails to conform to the foregoing limited warranty (the “Nonconforming Hardware”) is limited to repair or replacement of such Nonconforming Hardware, at Lubn’s sole option and election (the “Limited Warranty”). The warranty for the repaired or replaced Hardware is limited to the scope and duration of the original warranty for the Hardware. This warranty is contingent upon proper use of the Hardware in the application for which it was intended, as may be determined in Lubn’s sole discretion.

This Limited Warranty does not apply: (a) to consumable parts, such as batteries, door key storage component, key mags, pins, keychains, tag, or protective coatings that are designed to diminish over time; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship; (c) to damage caused by use with a third party component; (d) to damage caused by accident, abuse, misuse, fire, earthquake, lighting, power surges, flood, excessive moisture or other external cause; (e) to damage caused by operating the Hardware outside Lubn’s published guidelines; (f) to damage caused by service performed by anyone who is not a representative of Lubn; (g) to a Hardware that has been modified to alter functionality or capability; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the Hardware; (i) if any serial number has been removed or defaced from the Hardware; (j) if Lubn receives information from relevant public authorities that the Hardware has been stolen; or (k) if the Hardware has been used outside of United States.

WHAT IS NOT COVERED BY THIS WARRANTY?

This Warranty does not apply to any non-Lubn branded hardware products or any software, even if packaged or sold with Lubn’s hardware. This does not affect your rights under applicable consumer law. Manufacturers, suppliers, or publishers, other than Lubn, may provide their own warranties to you – please contact them for further information. Lubn-branded software is not covered by this Warranty. Lubn does not warrant that the operation of the Lubn’s Product will be uninterrupted or error-free. Lubn is not responsible for damage arising from failure to follow instructions relating to the Lubn’s Product’s use.

This Warranty does not apply: (a) to consumable parts, such as batteries, Key Storages, pins, keychains, tag, or protective coatings that are designed to diminish over time; (b) to cosmetic damage, including but not limited to scratches, dents and broken plastic on ports unless failure has occurred due to a defect in materials or workmanship; (c) to damage caused by use with a third party component; (d) to damage caused by accident, abuse, misuse, fire, earthquake, lighting, power surges, flood, excessive moisture or other external cause; (e) to damage caused by operating the Product outside Lubn’s published guidelines; (f) to damage caused by service performed by anyone who is not a representative of Lubn; (g) to a Product that has been modified to alter functionality or capability; (h) to defects caused by normal wear and tear or otherwise due to the normal aging of the Product, (i) if any serial number has been removed or defaced from the Product, (j) if Lubn receives information from relevant public authorities that the Product has been stolen, (k) if Lubn receives information from the Product’s location tracking service that the Product has been moved away from its original authorized location more than 12 hours, or (l) if the Product has been used outside of United States.

YOUR RESPONSIBILITIES

YOU SHOULD MAKE SURE THE PRODUCT CAN BE CONNECTED TO CELLULAR NETWORK BEFORE YOU INSTALL THE PRODUCT. YOU SHOULD ALSO HAVE BACKUP KEYS OF YOUR PROPERTY AGAINST POSSIBLE OPERATIONAL FAILURES. DO NOT LEAVE THE KEYS IN THE PRODUCT IF YOU OR PEOPLE WHO YOU AUTHORIZED TO ENTER THE PROPERTY ARE GOING TO STAY IN THE PROPERTY OVERNIGHT.

Before receiving warranty service, Lubn or its agents may require that you furnish proof of purchase details, respond to questions designed to assist with diagnosing potential issues and follow Lubn’s procedures for obtaining warranty service.

Important: Do not attempt to disassemble or repair the unit yourself or by any unauthorized individual. Disassembling the Product may cause damage that is not covered by this Warranty.

WHAT WILL LUBN DO IN THE EVENT THE WARRANTY IS BREACHED?

If during the Warranty Period you submit a claim to Lubn, Lubn will, at its option:

(i) repair the Product using new or previously used parts that are equivalent to new in performance and reliability,
(ii) replace the Product with the same model (or with your consent a product that has similar functionality) formed from new and/or previously used parts that are equivalent to new in performance and reliability, or
(iii) exchange the Product for a refund of your purchase price.

A replaced or repaired Product assumes the remaining term of the Warranty or ninety (90) days from the date of replacement or repair, whichever provides longer coverage for you. When a Product or part is replaced or a refund provided, any replacement item becomes your property and the replaced or refunded item becomes Lubn’s property.

HOW TO OBTAIN WARRANTY SERVICE?

Please contact service@lubn.com for any questions concerning this product including warranty questions or claims. If Lubn determines that your Product is eligible for warranty service, Lubn will send you a prepaid shipping label and instructions on how to properly pack and address your product, so that you may ship your Product to Lubn’s service location. Instructions may be sent to you via email. Once service is complete, Lubn will return the Product to you. Lubn reserves the right to change the method by which Lubn may provide warranty service to you.

DISCLAIMERS

If and part of this limited warranty is held to be invalid or unenforceable, the remainder of this limited warranty shall nonetheless remain in full force and effect. This limited warranty is the only express warranty made to you and is provided in lieu of any other express warranties of similar obligations (if any) created by any advertising, documentation, packaging, or other communications.

Except for this limited warranty and to the maximum extent permitted by applicable law, Lubn and its suppliers provide this product “AS IS AND WITH ALL FAULTS”, and hereby disclaim all other warranties and conditions, whether express, implied or statutory, including, but not limited to, any (if any) implied warranties, duties or conditions of: merchantability, non-infringement, quiet enjoyment, system integration, satisfactory quality, fitness for a particular purpose, reliability or availability, accuracy or completeness of responses, results, workmanlike effort and lack of viruses. This limited warranty cannot be transferred to any other person.

LIMITATION OF LIABILITY

Neither Lubn nor its suppliers shall be liable to you or to any third party for any indirect, incidental, consequential, special or exemplary damages (including in each case, but not limited to, damages for loss or corruption of data, loss of business, loss of profits, business interruption or the like) arising out of the use of or inability to use this product even if Lubn has been advised of the possibility of such damages.

Notwithstanding any damages that you might incur for any reason whatsoever (including, without limitation, all damages referenced herein and all direct or general damages in contract or anything else), the entire liability of Lubn and any of its suppliers shall be limited to the amount actually paid by you for this product.
